Acceptance of Terms

These Terms of Service (“Terms”) form a legally binding agreement between you (“Client”, “Student”, “User”) and A2FixTech (“Company”, “we”, “us”) for the use of our website and services.

These Terms apply to all visitors, clients, students, and anyone who accesses or uses our website at https://a2fixtech.com or engages us for any service.

Our Services

A2FixTech provides the following services:

• Digital Marketing — SEO, GEO, social media strategy, content marketing
• Website Design & Development — Business websites, eCommerce stores, landing pages
• PPC & Google Ads — Google Ads, Meta Ads, Performance Max campaigns
• AI Marketing Solutions — AI-powered content, automation, and campaign management
• Email Marketing & Automation — Lifecycle campaigns, lead nurturing
• Video & Reels Marketing — YouTube Shorts, Instagram Reels, TikTok content
• Learning Programmes — AI and Digital Marketing courses for students (Class 5–10) and professionals

Specific deliverables, timelines, and pricing for each project are agreed upon separately in a written proposal or service agreement before work begins.

User Responsibilities

By using our website or services, you agree to the following:

You Must

• Provide accurate, complete, and up-to-date information when contacting us or booking a service
• Respond to our team’s requests for content, approvals, and feedback within agreed timeframes
• Ensure you own or have rights to all content, images, and materials you provide to us
• Pay invoices on time as per the agreed payment schedule
• Use our website and services only for lawful purposes

You Must Not

• Use our website to transmit spam, malware, or harmful content
• Copy, reproduce, or republish any content from our website without written permission
• Misrepresent your identity or business when engaging our services
• Use our services to promote illegal, fraudulent, or harmful products or activities
• Attempt to hack, disrupt, or overload our website or systems

Payments & Refunds

Payment Terms

• All prices are quoted in Indian Rupees (INR) unless otherwise stated
• A non-refundable advance payment (typically 50%) is required before project work begins
• Remaining balance is due upon project completion or as per the agreed milestone schedule
• Monthly retainer services (SEO, ads management, social media) are billed in advance each month
• Invoices are due within 7 days of issue unless otherwise agreed in writing

Late Payments

• Work may be paused on projects with overdue invoices beyond 14 days
• A2FixTech reserves the right to charge a late fee of 2% per month on overdue amounts

Refund Policy

• Advance payments are non-refundable once work has commenced
• If A2FixTech cancels a project before starting, a full refund of any advance paid will be issued within 14 business days
• No refunds are provided for completed deliverables that have been approved by the client
• For learning programmes, fees are non-refundable after the second session. A one-time reschedule to a future batch is available if requested before the programme starts

Intellectual Property

Content We Create for You

Upon full payment of all invoices, intellectual property rights for custom deliverables created specifically for your project (website design, custom content, ad creatives) transfer to you, the client.

Our Website Content

All content on a2fixtech.com — including text, graphics, logos, images, course materials, blog posts, and service descriptions — is the exclusive intellectual property of A2FixTech and is protected under Indian copyright law.

• You may not copy, reproduce, or republish our website content without prior written permission
• You may share links to our blog articles and pages with appropriate credit

Third-Party Tools & Software

We use licensed third-party tools (WordPress, Elementor, Google tools, Meta tools, etc.) in our work. These remain the intellectual property of their respective owners. We do not transfer any third-party software licences to clients unless separately agreed.

Client-Provided Materials

You confirm that all content, images, logos, and materials you provide to us are either owned by you or that you have the legal right to use them. You indemnify A2FixTech against any third-party intellectual property claims arising from materials you provide.

Confidentiality

Both parties agree to keep confidential all non-public information shared during the course of our work together. This includes:

• Business strategies, marketing plans, and campaign data shared by the client
• Pricing, proposals, and proprietary processes shared by A2FixTech
• Login credentials, access details, and account information shared for project purposes

We will not share your business information with any third party except our trusted service partners who are under similar confidentiality obligations, or as required by law.

This confidentiality obligation remains in effect for 2 years after the end of our working relationship.

Limitation of Liability

A2FixTech provides digital marketing, design, and educational services with skill and care. However, we cannot guarantee specific results such as a particular search ranking, number of leads, or revenue growth, as these depend on many external factors beyond our control.

We Are Not Liable For

• Loss of revenue, profits, or business opportunities resulting from our services
• Changes in Google, Meta, or other platform algorithms that affect your rankings or ad performance
• Website downtime, data loss, or technical issues caused by your hosting provider or third-party platforms
• Inaccurate results caused by incorrect or incomplete information provided by the client
• Any indirect, consequential, or incidental damages arising from use of our services

Our total liability in any case is limited to the amount paid by you for the specific service in question in the preceding 3 months.

Termination

Termination by Client

• You may cancel an ongoing monthly service with 30 days written notice via email to a2fixtech@gmail.com
• All outstanding invoices must be paid in full at the time of cancellation
• Work in progress will be delivered in its current state upon receipt of final payment

Termination by A2FixTech

We reserve the right to suspend or terminate services immediately if:

• Payment is overdue by more than 30 days
• You engage in abusive, threatening, or unlawful behaviour toward our team
• You use our services for illegal, unethical, or spam-related activities
• You breach any material term of these Terms of Service

After Termination

• We will return all client-owned materials (logos, content, data) within 14 business days
• Access to any shared accounts or tools will be revoked
• Confidentiality obligations continue as per Section 6

Learning Programme Terms

The following additional terms apply specifically to our AI and Digital Marketing learning programmes for students (Class 5–10) and professional training courses:

• Enrolment: Confirmed only upon receipt of the required fee. Seats are limited per batch.
• Attendance: Students are expected to attend all scheduled sessions. Missed sessions may be covered via recorded material at our discretion.
• Batch Changes: One free batch transfer is allowed if requested at least 7 days before the programme starts. After the programme begins, batch transfers are subject to availability and an administrative fee.
• Certificates: Certificates are issued only upon completion of the full programme and submission of the final project.
• Student Conduct: Students are expected to behave respectfully in all sessions. Disruptive behaviour may result in removal from the programme without refund.
• Content: All course materials, videos, and resources provided are for personal learning only and may not be shared, copied, or resold.
• Minors: For students under 18, a parent or guardian must provide consent at enrolment and is responsible for ensuring the student meets programme requirements.

Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms or our services shall be subject to:

• First, an attempt at amicable resolution through direct communication within 30 days
• If unresolved, the exclusive jurisdiction of the courts in Pune, Maharashtra, India

These Terms comply with the Indian Contract Act 1872, Information Technology Act 2000, Consumer Protection Act 2019, and the Digital Personal Data Protection Act 2023.

Changes to These Terms

We may update these Terms of Service from time to time. When we do:

• The “Last Updated” date at the top of this page will be revised
• Significant changes will be notified via email to active clients and newsletter subscribers
• Continued use of our website or services after changes constitutes acceptance of the new terms

We recommend reviewing these Terms periodically. Previous versions are available upon request.

Miscellaneous

• Entire Agreement: These Terms, together with any signed project proposal or service agreement, constitute the entire agreement between you and A2FixTech.
• Severability: If any clause of these Terms is found to be unenforceable, the remaining clauses continue to apply.
• Waiver: Failure to enforce any part of these Terms does not constitute a waiver of our right to enforce it later.
• No Partnership: Nothing in these Terms creates a partnership, joint venture, or employment relationship between you and A2FixTech.
• Force Majeure: A2FixTech is not liable for delays caused by circumstances beyond our reasonable control, including natural disasters, internet outages, or platform changes by Google or Meta.
